  • query regarding I-94

    Hi,

    I have two questions:

    1.

I have I-94 which I got while I entered the U.S. two years before. But that I-94 is expired. Since I am in H1B my employer extend my visa, along with my visa approval I got a new I-94. I am filing green card through my husband(marriage based). While I requesting I-485 I have to provide a copy of my I-94 both sides. Which I-94 should I have to send. Either the new one or the old one which I got two years back. Thank you.

    2.

I have my visa stamped on my passport is expired. But I have new H1B approval notice, but didn't get stamped in my passport yet. Is that will become a problem while I apply for my I-485.

    Thank you.

Any pointers towards this issue is highly appreciated.

    1. The current valid I-94 is enough. As the white one shows details of POE, send both. They should contain the same number though.
    2. As long as you are maintaining H1b status and getting paid, no issues.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
