  • Naturalized Citizen sponsering wife (on H1B)

    Me and my wife are both in USA. I recently become a citizen through naturalization and would want to file GC for my wife on family based greencard. She is currently on H1B and has been in USA for around 13 years. Can people on the forum assist me by answering the following questions?

    1. What forms do I need to file for her green card? I was planning on filing the following. Any additions or deletions?
    a) I-130
    b) I-864 (she already has 40 qualifying credits). Is this form required?
    c) I-485
    d) I-693
    e) I-765
    f) I-131

    Questions on 1-130 section c
    14) Does this question mean her last arrival or first arrival?
    16) What does immigration proceedings mean? Does having an H1B classify as immigration proceeding?
    18) Wife already in USA. How do I answer this?

    Question on I-864
    1) As mentioned above, my wife has been in USA since past 13 years on different Visas and now on H1B. She already has 40 qualifying quarters of credits. Is she exempt for this form? If so, how does USCIS know that she has accumulated enough credits?

    2) Her income for 2007 was only 12K as she spent most of her time in India. She has health insurance through me. We have a joint bank account and joint tax filings. Would her income be a concern? If so, is applying I-864 a better option?

    Any other tips that I can benefit from?
