Need urgent Help.. (i130, i485, i765)

Hi,

I am on H1B right now. My wife has filed I130, with I485 and I765. I have received finger print appointment for next week in Maryland. I am planning to go to India for a month after finger pint is over. Can i come back to US since my H1B visa stamp is still active? or I might have to wait till my EAD or green card comes?

I had similar situation like your. I am on H1-B Visa and approved I-130 which was filled by my GC spouse. I went out of country couple of times and never had problem with reentry on H1-B, since i had valid h1-b visa stamped.

As long as you're still employed by the company that petitioned for your H1-B, and it's still valid, then you should be able to come and go as you please...
