    i've been reading most of the posts here in regards of my daughter's case. i find the posts here very helpful and hopefully i can find answers to help her work on her paperwork..
    she had a dependent visa and overtayed, now shes married to a usc and working on applying for her green card, the question is she didn't have a ssn but she worked and paid taxes but didn't file for a return. she received checks and pay stubs. now on the g325a form it asked her for her employment record. does she need to put that record down? if she does, will she get in trouble? will the immigration people check her background such as bank accounts etc.? i just wanted to know the right answers to file these papers for my daughter.
    any valuable help will be appreciated....

    I'm just curious in knowing ...

    ... what do YOU think? Do you think that USCIS is not going to check anything at all?

    Either way, do you intend to lie on the most important application if you think that USCIS will not check into the details of your daughter's past wrong doings?

    Do you realize that even if your daughter did get her GC that way, she can still be deported any time USCIS finds out that she lied on her application?

    This should tell you what you need to do. Tell the truth and absolute truth. She will be able to get away with a lot of things due to her marriage to an USC, but she needs to mention the truth to ensure her future is secure in United States.

      Not FILING taxes is a criminal offense. Does not matter if she "paid" them or not, how does she know that she does not own them anyways? she needs a CPA.

        she don't have a ssn so she just used her iTIN when she worked. she said she kept her pay stubs and it showed how much tax the employer deducted on her pay check

        thanks for your response, my daughter and i are just really worried that she may not be able to get her gc if she state that she worked since she already overstayed and worked illegally but she never had a ssn...

          Logical reasoning ....

          ... your daughter used TIN from IRS to work and earn, don't you think it would have been wise to use the same TIN to file for her taxes?

          I am sorry, but mentioning that she did not have SSN does not help her. The least she should have done was to approach the IRS or a local CPA.

          As advised, it would be in her best interests to hire a CPA and analyze her past earnings. If she owed taxes to the IRS, she would have to pay the same plus penalty, however if she owed refunds, she may be in luck.

          Either way, get everything in the past cleared out and then file for the GC, it will help her for life.
