  • I-130

I am a Canadian Citizen and married a US citizen this past September. I am currently still in Canada and he is in the USA although our marriage took place in the USA.
I cannot find the answer to my question straight forward on any web site I visit and need help to know where to start.

We want to do everything legally and don’t know if I have to be in the USA to start filing the paperwork or if I have to remain in Canada while we file the I-130, Petition for Alien Relative for myself and my daughter.

Can you help, or offer a place I can find the information? I cannot call the 1-800 customer service number from Canada.

You can do it either way.

If you want to get everything processed while in Canada, look at https://www.immihelp.com/family-based-greencard/index.html

If you want to get it partially processed while in Canada, and rest in US, look at K3 visa at https://www.immihelp.com/usa-visas/kvisa/ On that page, look at K3 visa vs. Immigrant visa comparision to see which works better for you.
