Hello,
I have a valid H1B visa in my passport. My wife has filed for my green card after marriage. She filed I130, along with I765 and I485. My Biometrics has done on 12/09/2008.
I also have received letter from USCIS mentioning missing docs (Eg. my birth certificate, and Immunization report to be sent in 90 days).
I am planning to got to India for one and half months for traditional marriage.
My question is can I come back with my H1B visa still active? or ther will be a problem if EAD comes before i make a re entry in the US?
