  • Affidavits for I-751 (petition to remove conditions on residence).

    Hello everyone. I am wondering whether we can ask people who are neither US citizens nor permanent residents to write affidavits in support of our I-751 petition (asserting that they know our marriage to be real and so on). In the instructions for completing the form, nothing is mentioned about the citizenship or residence status of people writing the affidavits, but elsewhere on this website I have seen it written that they should be US citizens or permanent residents. However, the parts of the site where this is mentioned are quite old (from 2004 I think) and also mention things which no longer apply, such as the affidavits being optional (sigh) and there being no biometric procedure (double sigh) so perhaps They have dropped the citizen or resident requirement for the affidavit people. Does anyone know what the truth is?

    Our problem of course is that we are very international and most of the friends we know *since I was granted a conditional green card* are foreign while most of the American friends who know us well are people we met after I got the green card and are therefore ineligible to write these affidavits.

    Another thing: by affidavit do They mean a document witnessed by a notary public or any such thing, or do they just mean a letter where the person adds an "I swear the aforementioned to be true and correct" clause and then signs it? Again, the instructions do not make that clear.

    I am not sure about 3rd party been required to be US Citizen or Permanent Resident but if you look at the instructions for several forms when applying for Green card (I-130 for example) it still says
    "Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage);"

    and this form is from just last year. And also as far as I know "affidavits" means it has to be notarized. I hope that helps. Thanks.

      Hello, and thanks very much for answering.

      The instructions for completing the forms provided by The Guvvmint basically say what you say, namely, that They require at least two affidavits by people having known both parties to the marriage since before the green card was awarded and containing various pieces of information including the writers' names, addressed and dates of birth and details of their familiarity with the marriage. No mention is made of nationality or immigration status and no mention is made of any specific form that should be used to somehow validate the text.

        Do I have to submit affidavit for I 751?

        I am applying for I 751, petition to remove conditions on residence.

        Can you advice me if I have to submit an affidavit or not?
        I am submitting other documents as proof of evidence of marriage such as joint home ownership, bank account, travel documents, health insurance etc

        Please let me know.
