  • H1 marrying a US citizen

    My friend is a H1 holder who has already applied for his GC and he plans to marry a US citizen. Is it faster to get a GC through his wife or his employer? How long does it take to get a GC through spouse? Also what forms does he have to fill out? Please advice

    It is faster through family. It usually takes between 6 - 12 months to get a GC. He will get an EAD within 2 months. However, if he has been married for less than 2 years, he will get a conditional GC for 2 years and will have to file after expiration date to get a permanent GC.

    I-130, 131, 485, 685, 765 ... way too many forums on this info.

      Thank you for the response. However, I do have a few more questions.
      It usually takes between 6 - 12 months to get a GC.- is this conditional GC or permanent GC?

      What is the time period before you get a conditional GC?

      If he's on a EAD, can he go to school? What status would he be on if he plans to go to school?

      Does everyone get a conditional GC when they first apply or it's only for people who have been married for less than 2 years?

        - It will be a conditional GC valid for 2 years

        - He can go to school work etc on EAD. Only if he has to leave the country, he will need to get Advance Parole ( I-131 ).

        Yes, anyone with less than 2 yrs of marriage gets a conditional GC.
