  • Hello Everyone

    Hi,

I am on H1-B visa and got married to USC in Dec'08. I was gathering information to file family-based GC. I have following questions :-

    Form I-130 :-
Que 1) For supporting documents : copy of my wife's naturalization certificate
    copy of her passport
    copy of her birth certificate
    copy of my birth certificate
    copy of our marriage certificate
    our photos
    apartment rental/lease agreement
Other than above mentioned supporting documents, do we need any
    other..? Wedding photos..? DVDs..?
I read somewhere on uscis website under "what documents do you need
to show that you are a U.S. Citizen" under 5th bullet : An original
statement from a US consular officer verifying that you are a US citizen
    with a valid passport.
    Does my wife need it..?

Que 2) In Q#14 on the form "If your relative is currently is the US, complete
the following : He or she arrived as a : "
We should mention H1-B (Work Permit).. right..? I first entered US on
student visa (F1), completed masters and now working on H1-B visa.

"Date authorized stay expired, or will expire, as shown on Form I-94 or I-
    95"
We should mention the expire date mentioned on H1-B visa stamp on the
    passport.. right..?

    Que 3)
    Total I have to send following forms : I-130, I-485, G-325A, I-131, I-765,
I-864. Are there any other forms to go in this packet..? Do we need to
    sent I-693..?
    Any other supporting documents..?

    Thanks in advance

      Que 1:
you need only the copies; keep the originals for the interview, keep the evidence like leases, bills, receipts, wedding photos for the interview too - don't mail those.
Passport OR birthcertificate of the IS citizen would be enough.

      Q2:
Enter the status you entered with: if you were a student then it's F1

      Q3:
You don't have to submit I-131 unless you need to leave the US soon. And you will certainly need to pass you medexams. You need a civil surgeon; check www.uscis.gov under permanent residence, you'l find a link there, just enter your zipcode and it'll give you a list of doctors in your area.

      Good luck!

however one question : "bkwld" said for Question # 2 it should be the most recent entry meaning H1-B and "johngrnmn" said Student (F1).

can either of you or someone confirm which is the correct answer..

and btw sorry for the double post.. i didnt see a link to delete the post.. let me know how can i delete and i will get rid of one..

Yes, it should be the most recent entry. It says

'He or she arrived as a:'

So it is your status at the time you arrived in the US. I thought it is F1 and you switched to H1B later (within the US). Or if you went back home to get H1B and then reentered the US under a new visa which is H1B then of course you need to put H1B. It's what it says on the I-94 you got in your passport! Check there and enter it!
          Good luck!

            Thanks John.

Sorry I should have been clear in my question. I came here on student visa, completed masters, went to india couple times and got my H1-B stamped there.

But anyways, you cleared my confusion.
