  • URGENT : PLS HELP : I-130 Questions

    Hi,

    I am on H1-B visa and got married to USC in Dec'08. I was gathering information to file family-based GC. I have following questions :-

    Form I-130 :-
    Que 1) For supporting documents : copy of my wife's naturalization certificate
    copy of her passport
    copy of her birth certificate
    copy of my birth certificate
    copy of our marriage certificate
    our photos
    apartment rental/lease agreement
    Other than above mentioned supporting documents, do we need any
    other..? Wedding photos..? DVDs..?
    I read somewhere on uscis website under "what documents do you need
    to show that you are a U.S. Citizen" under 5th bullet : An original
    statement from a US consular officer verifying that you are a US citizen
    with a valid passport.
    Does my wife need it..?

    Que 2) In Q#14 on the form "If your relative is currently is the US, complete
    the following : He or she arrived as a : "
    We should mention H1-B (Work Permit).. right..? I first entered US on
    student visa (F1), completed masters and now working on H1-B visa.

    "Date authorized stay expired, or will expire, as shown on Form I-94 or I-
    95"
    We should mention the expire date mentioned on H1-B visa stamp on the
    passport.. right..?

    Que 3)
    Total I have to send following forms : I-130, I-485, G-325A, I-131, I-765,
    I-864. Are there any other forms to go in this packet..? Do we need to
    sent I-693..?
    Any other supporting documents..?

    1)
    -1 photo of you
    -1 photo of USC
    -your Birth Certificate (if its not in English, certified translation)
    -your copy of passport (just the biographic page), US Visa, I-94
    -USC's Birth Certificate
    -USC's copy of passport (just the biographic page) if USC is born in US or else need copy of naturalization certificate if naturalized
    -Certified Marrigae Certificate for both of you
    Nothing more. you don't need to prove that you're married at this point other than the item required above. Don't send in pictures, or joint accounts, at this time.

    2)
    -This should be the most recent entry in to US, not the very first time.
    -Most recent I-94
    -H1B expire date on your Visa or I-94 (for those with H1B extension)

    3)
    -yes all of the form you mentioned. There should be two set (4 per person) of G-325A. One for you and One for USC.
    -I-693 really is the sealed medical exam. You don't need to fill them out as doctor will need to do that. However, you should download the latest Form I-693 from uscis.gov and take that with you to the doctor, and ask them to use that. The reason behind this is that sometimes, the doctor's office have old expired forms laying around and they might use that and it might be rejected from USCIS later. Just to be safe. Another hint regarding the medical exam, the cost can be high, so call around in your area, cost varies. If you have shot records of you, take it with you, and make sure to ask the doctor, you do not want shots or test if not necessary as this will help with costs.
