  • Green Card thru marriage, I-94 question

    Hey guys,

I've read most of the postings and I appreciate the replies. I do have a question though that hasn't been asked/answered yet. I am on H1-B just got married to US Citizen and applying for Green Card. I have traveled home (outside US) several times with one I-94 and since my last trip 2 years ago my H1 visa has been renewed and I got a new I-94. My questions are:

When I fill out forms like I-485 and I-130 and others I've been asked to put where and when I last entered the country and what my I-94 number is. Sometimes I've been asked to enter I-94 number without other questions. Which one should I put? Should I always put the new one? Or should I put old one when there are questions about my last entry into the US? Or should I put both and just note that one is expired and one is new? Please help. Thanks.

You should enter the date you arrived in the US, it is on the stamp on you I-94 card which you got at the airport. Otherwise, if you extended you visa and got a new I-94 then although it is new it should bear the same number as the old one. Check it and I am pretty sure it is so. They do not change the number of the I-94, only issue a new one with a different expiration date.

Thanks for your response. I did check and the numbers are different on I-94, unfortunately. hence my dilemma.

Put the most recent I-94 information.
