  • Fee Waiver Help

Hi, I'm a British national currently living in California with a J-1 student visa (exempt from the 2 year home resident requirement) which expires in June. I am married to a US citizen and we found out a couple of weeks ago that she is pregnant (due August 31st).

My question is regarding the fee waiver for my green card application, has anybody had any experience dealing with this? My wife called the USCIS regarding the fee waiver the woman on the phone gave her the impression not too worry too much about it and just apply. But as you can imagine it is something to worry about, considering we cannot afford to pay the substantial fees associated with my green card application.

My wife works but isn't on the books so too speak, and her employer is cutting down her hours, and we are loosing money which we need to live on. I am restricted to working only 20 hours, and we use my student loan, which is not going too far these days as the British pound has plummeted in value in the recent months. We are both very worried that we cannot afford to pay the green card fees, and I am very worried about being deported just before my wife gives birth, which will be heartbreaking to say the least.

I have read through the fee waiver guidelines and my J-1 visa doesn't seem to be included in acceptable visas for the fee waiver. We also understand that if we declare that we have an income that is below the poverty line then that in fact is means to be excluded from being eligable for a green card. Is there anything that may be avaliable to us in our circumstances, because I really need to at least apply for my green card so I can get work authorisation so that I can provide for my wife, her daughter and our baby when he/she arrives.

Any help would be greatly appreciated,
    thank you
