I am us citizen filing for parents..can underage sibling come?

Hi,
I am a U.S. Citizen born here and am filing for my parents who stay in india. Can my brother and sister (both under 18) come to united states with them? i have filed another I 130 for them also. Affidevit of support section 3(9) says the principal immigrant can bring spouce/children with them, if so and i am sponcering them i should add their names!! i m very confused and am calling NVC ...ofcourse no help!

They can not come at the same time with your parents.

In fact they will have to wait several years for a visa to become available for them.

That is a good question... maybe your parents should not come until the minors have left the home?

What PraetorianXI said is absolutely correct. PraetorianXI and txh1b are very senior members on this forum and just because you didn't get the answer that was favorable to you, you don't have to get mad at them. And above all, everyone on this forum who is answering the questions is doing a favor to anyone who is asking a question. And you are getting all this for free. Therefore, restrain yourself.

Coming back to your original question:

Minor children can accompany their parents only if parents are coming under a limited quota category, such as F1 through F4. However, parents of US citizen fall under immediate relative (IR) category and therefore, each application is separate and no dependents allowed. That is, one for mother and one for father. Their minor children can't accompany with them.

Siblings of US citizen fall under F4 category and it takes around 13 years now for them to come.

Your question about where those kids are going to stay after their parents immigrate is valid, however the law has no sympathy for it. That is something the parents need to decide regarding how they need to deal with their own family members.

If you see other people's answer wrong if they are not suitable to you, get out of here. Run behind the attorneys and spend $$$$, and still get the same answser that minor kids can't accompany parents when they are sponsored by other child that is US citizen.
