I was hoping that some of you could provide some advice. All recommendations are appreciated.
I am a US citizen and my wife is a foreign national. We both reside in a foreign country with residence status. I will be filing an I-130 on behalf of my wife for an immigrant visa (green card) at the local US consulate. We understand that there is a 6 month time limit to enter the USA and validate the green card upon receipt of the immigrant visa.
However in our case this does not appear to be enough time as we require 2-3 months to transition and would also like to travel for another 6-8 months. At the moment I see the following options:
(1)Try to squeeze everything into the 6-month time period though this will prove difficult given the unpredictability of immigration procedures.
(2)Upon receipt of the immigrant visa, travel to the USA to fulfill the 6-month requirement. We would stay a few days or a bit longer then leave again to travel returning in maximum 8 months. Would my wife risk her permanent residency in this instance?
(3)Same as option 2, although we could stay long enough to apply for a re-entry permit.
Do any of you have any suggestions or recommendations here? Thank you.
