I got my US citizenship in Oct 2008. I am planning to apply GC for my own brother who is above 21 years and not married. This process may take more than 10 years according to present bulletin.
Previous History :
My brother is working in IT (Software) in India. We tried H1B in 2006 but that was rejected due to some company documents. The company was not able to prove that they have a job requirement for the candidate when INS enquired. Then, we did not apply in next year that was in 2007. Then again we applied H1B in April 2008 but it did not pick in lottery. Now, it is impossible to apply in 2009 because of economy and government restrictions, no company are willing to apply H1B.
Need help or advice from experts:
1. What is the best way/visa for him?.
2. Is it good to apply "Family Based Green card" and wait for 10 years?
Or better to wait for economy to turn around and then we can apply for H1B?.
3. Does US government will ever free the H1B visa's again any time soon?.
4. Can we apply H1B even after we apply for "Family Based Green card" ?.
Please advice me in this regards.
