  • Change of status to permanent resident

    Hey,
My parents got their green card in sep 2008 and applied for me. However I am already in the US on F1 and my visa expires in December 2012. I was wondering how long do I have to wait before I can change my status and whether I can do it before my visa expires. I got the Receipt number letter saying they have received my visa application and I am waiting for A number or the visa number so that I can apply for change of status. I am unmarried over 21 years of age.
Really would appreciate a quick response.

First of all your parents (your father or mother, the one who petitioned you) must be a US Citizen for you to apply for I-485 when the visa is available. Second you MUST maintain your legal status until then if you are planning to file for adjustment of status. Your visa expires on 2012 but for F-1 it will be for Duration of Stay (meaning whenever your study is complete).

    Parents Greencard 09/2008
    Parents expected US Citizen 09/2013

Currently you are category 2(B) unmarried child over 21
They are currently processing priority date of NOV 2000

When your parents (your father or mother, the one who petitioned you) obtain a US Citizenship you will need to notify the USCIS of your new preference category which will be 1(A) which they are currently processing priority date of SEP 2002.

The dates can change when your parent get their US citizenship.
