  • I am worried, please help!

I met my wife in 2007 and decided to get married a year ago, she just became a naturalized US citizen and we are about to file a petition to obtain a residence through marriage for me, but there are a few issues: 1) I entered the USA in 2002 with a tourist visa, but then I applied for a change of status to a student visa, so I could stay here studying. In 2006 I had to withdraw my classes so I fell out of status, I've been like that since then. 2) I have been working without permission since 2007. 3) I had to go to the hospital because of an appendicitis, but there are still bills I haven't paid. 4) I went to jail because I had a ticket for no insurance and failed to pay the surcharge payment plan of three years in Texas so my license was suspended. I have taken care of that already. I asked and somebody told me I was not going to be able to get the green card and I was going to get deported. Is that true? Can I still obtain residence through marriage? If so, what actions should I take? I will greatly appreciate any help and advice. Thanks.

Hi! I think all your issues concern will be ask but since your wife is a US citizen, she can file a waiver for your out of status... most probably you will not be deported because you're now an immediate relative but you're still legally responsible to all your unpaid hospital bills. However I'm still suggesting you to get a reputable lawyer. Good luck!
