I think this is little bit of a complicated situation. My wife and me both Indian citizens are staying in US. My wife is a US resident through a petition submitted by her father. I am working on H1B. So if I were to claim GC based on her I have to wait for her to become a US citizen if I want to avoid any visa number limitation and backlog
Now my wife's sister (who is a US citizen) had filled for her GC back in 1998 under F4 category (brother and sister of US citizen). She got her GC through her dad while this one was still pending. The F4 category petition dates are current now for 1998. So if she were to get her GC under F4 category, I would benefit as a derivative spouse and can get my GC by end of this year. Like you guessed the only problem in this is that she is already a GC holder. So this sounds like a good opportunity for me but not sure how to work around she being a GC holder already.
