  • what options i have to stay in US?

    hi guys,
    im right now in US on OPT. my grandfather filled immigration petition for my mother in may 2003. now they have recieved the approval letter from immigration. how much time it will take for may parents to get visa for US ? Am i eligible for greencard bcoz at time of petition my age was 20 and now im 24?
    if my parents get the visa n they come here with green card then what option i have to stay in US bcoz my OPT is going to expire n i dont want to go to F1 again. i mean by anyway can i come under my mom's file ?
    please help me guys....

    I think you should schedule an appointment with an CIS information officer and discuss the situation. You mention that the I-130 wasn't approved until now, at which time you're already over 21 so I don't think you can be part of that I-130.

    So if that's the case you're parents immigrating to the US with a visa won't grant you any status. They can petition for you once they get their visas but that doesn't mean you'll be allowed to stay.

    Unfortunately F1 visas and OPT are non-immigrant visas, meant for those not intending to stay.

      u mentioned that consult CIS officer. actually what is a CIS officer and how can i take an appointment with him?

      i know that F1 and OPT r non-immigrant visa but i was asking that can i transfer some other status so that i can stay and work in US after my parents enter with US greencard? like i can show that im waiting on my greencard and i dont want to be separated from my family. is that possible?

        Unfortunately "waiting for a greencard" doesn't grant anyone status. Of course anyone can try to change their status to some other non-immigrant visa (but whether they can find a willing petitioner is a different issue).
