    I am a US born citizen. February 12, 2009, I married a lady from Alberta Canada. We have downloaded all the required forms and have almost all the required forms filled out to start her on the way to getting a green card for residency and/or a citizenship. We have run into a block every path we take and the red tape is at times almost overwhelming, but we keep on working on it.

    We have a question, we have been told by several people that she can only stay in the US so many days a year. Since we are legally married in the US (Alabama), and my home is in Alabama. We take several over seas trips and go to Canada as often as we can.
    Can you tell me the official rules as to how many days Jeanette can legally stay in the US until she can get her papers accepted through the immigrations office. Is the number days for a year if so does it go from January through December. or does it start over every times she leave and reenters the US.

    Can you answer our question and send me the section that covers this problem and any other pertinent information associated.

    Once you file I-485, she can stay indefinitely. And you can file I-485 right away, along with I-130.

    I am not sure you sent an email to I-140 department at DHS. That is for employment based greencard.
