    Thank you Klast for your response, our case was approved in Jun 2009, while it will be current as you said in 19 months. I tried to explore in the internet that we can only write USCIS or NVC 60 days before my son turns 21, it means, I can write them in 12 May 2013 which is 19 - 7 = 12 months to go in order my PD will be current.

    Do you think CSPA can help me with 12 months to be current?

      Forgot to say you will be current in about 19 months IF you're under China, Worldwide or India as your territory. Where are you from?

      If you're from China, worldwide or India then CSPA can help your son.

      If you're from the Philippines or Mexico then your son won't be able to go to the US with you.

        Message Klast and ask for the number of the lawyer he used for his *Humanitarian Reinstatement of the I-130 petition* his mother who died filed. If you don't get a response from him in 2 days have your parents find an EXPERIENCED lawyer to handle your case. You and your family need to get on this pronto/ASAP since you expect to have an interview in Dec/Jan and you don't want to be delayed unnecessarily.

            yh , we will contact a good immigration lawyer asap.
            plz suggest and share anything regarding this ,I am really worried.After waiting so long , now it seems we have lost the battle

              I am so sorry to hear this Mann. That too is one of my biggest fears as my mom is now 73. I will research this topic on other sites and forums. If I learn anything new I will share with you. You have reached so close. I urge to not give up, and to think positive. Keep us posted. You will be in my prayers. keep the faith !

                I'm sorry to hear this sad news. But don't lose hope. Find a good lawyer (maybe Atty Gurfinkel or Atty **** **** **) and hopefully you'll get your visa. Keep us updated. Good luck.

                      If your country is not listed then you're grouped under Worldwide.

                      Since you're Worldwide your PD (priority date) may become current or scheduled for an interview in 19 months. If you were actually correct when you say your petition was approved in June 2009 then it took atleast 6 years to be approved.

                      So based on the dates you gave:
                      PD = May 22, 2003
                      Approved = atleast by June 1, 2009
                      21st birthday = July 12, 2013

                      Age as of Nov 6, 2012 = 20 yrs & 3 mths
                      CSPA age as of Nov 6, 2012 = 14 yrs & 3 mths
                      CSPA age on July 12, 2013 = 15 yrs
                      CSPA age in 19 mths (from Nov 6, 2012) = 16 yrs
                      Son ages out completely = April - May 2019.

                      Please make sure your petition was approved in 2009.

                      Since you have time on your son's side focus on hoping your petitioner remains in good health for the next 2 years and if he/she passes, know exactly what your family should do. Best wishes to you and your family.

                        My petition was actually approved in 22 Jun 2009. If I have to wait in 19 months, my son will not be eligible (he is over 21), that is why I want to send a letter to expedite the process. MY question again, is there any chance my request will be approved? or it depends on the availability of the visa in May 2013??

                          You can request for expedite but it still depends on visa availability.
                          What Aaydrian is trying to say is about CSPA. Your son may be eligible for it so even if he aged-out when PD is current his CSPA age can be computed to be 7 years minus the actual age when PD becomes current. Search about CSPA to know more about it. Good luck.

                            I meant in 2019 your son's CSPA age will be 21 and if you are not current by then (don't worry you WILL get an interview long before then) your son definitely won't be going to the US with you.

                            I don't know if you'll get an expedite especially because I've never heard of anyone who did get one. My *OPINION* is I don't think you will because you're going to still be too far behind being current AND visa numbers are too scarce for them to allow your family to cut the line and be placed at the front. A lot of people have kids that had to use CSPA to get them visas. With only 23, 400 visas and being 10yrs behind can you imgine if everyone got an expedite for their kids who are turning 21? However that's my opinion so do whatever you think is in your family's best interest.

                                That's good news but no haven't received a thing. It seems every category is slow in getting I/Ls this month. Don't have a clue why they are keeping the letters hostage.
