    Hi

    I am a LPR and my daughter missed out in the original F4 application because she aged out.

    Do you think my husband and I both can jointly apply for her under 'unmarried children of permanent residents " category ? If so should we fill out two I 130's ?

    Is you husabnd a LPR or a citizen?
    You cannot file jointly. Usually only one parent will petition. The only instances where parent file two different petition separately is because anticipation that one might pass of old age or one or the other will not qualify for a Citizenship and this is done as a precaution.

      Yes. We both are LPR's. The reason I asked this question was that it takes such a long time, as much as 8 years to become current and you may never know what might happen.

      I decided to apply under my husband's name because he stands a better chance in becoming a citizen in 3 more years. I might have to go back to be with her and keep coming once a year to keep LPR status alive.
