  • Reentry permit denied

My father who was staying with me here is US, got his greencard through my sponsorship. My father left US on Aug 9, 2008 because my mom back home suffered a cardiac arrest and was on comatose for weeks before she passed away. He has to stay there indefinitely to take care of my very sick brother and settle other family matters. Just right before my father left US, I filed an application for reentry permit. The required biometrics was done in the local US embassy on May 18 2009. It appears the embassy has not forwarded my father's biometrics papers to the Nebraska office. I received the notice that the reentry permit was denied two weeks ago. Then last week I sent a letter to the Nebraska office explaining them about the arrangement with local US embassy (complete with proof/documents). I have not received a reply from the Nebraska office yet. Should I formally file a motion for reconsideration? or should I ask my father to fly back to US before Aug 9? Thanks a lot!

If your father is a GC holder he cannot request required biometrics at US embassy for reentry permit. You should have received ASC appointment letter from USCIS. He needs to come back and start reentry over.

      Reenty permit denied

We received appointments for biometrics to be done here in US but we requested for rescheduling. The US Embassy in Manila allowed my father to do the fingerprinting done there and he was told by embassy staff that his papers will be forwarded to US. They should have told us from the onset that this is not allowed. Now, my concern is time. I might have to file an appeal.
