Dear IMM Help,
I filed petitions for my two brothers and parents under relative category (I-130) in 2003 at the same time but separately.
My one brother and parents petitions are already processed and approved for further processing and waiting for priority date. However I do not know about petition of my another brother.
I am surprised that they processed two of three petitions but never acted on third. I wrote many letters to various USCIS offices nation wide and still I do not get any response. Even I called National Customer Service center numerous time and their response is 'pending'. I also wrote many letters and send AR-11 form for change of address, but no response.
It has been six years and I am afraid that they might have lost the file of my brother.
What shall I do in these circumstances?
I need your help to further direct me. Certainly I do not want to file another new petition or else priority date will be pushed back to another 10 years.
Althoug I do not want to go through the route of suing USCIS under Nationality & Immigration act for denying my rights, however, that is only the option is left in my opinion.
I am sure you will be able to help me and provide guidance.
