  • 1-130 Marraige Certificate and 1-485 Birth Certificate question

Hi - I realize there are a few posts related to this but I would appreciate any answers to my two questions.

    1. I am a US citizen and am applying for GC in USA (1-130 and i-1485 together) for my father only when he visits me in two weeks. My parents were married in 1963 but never registered and now father has been told (verbally) at Marraige Court in India that he cannot get a marraige certificate now as my mother is no longer alive (we have her death certificate). So he has got affidavits in prescribed formats by two witnesses for his marraige. Will this suffice or he needs to get a specific letter from some authority too that marraige certificate is not issuable due to death of my mother? Any other advice/help here?

    2. My father was born in 1929, is nearing 80 years and does not have birth certificate. His village that he was born is practically non-existant. His 1 elder brother and 2 elder sisters have already passed away so there is nobody elder to him to provide an affidavit. My father has a matriculation (10th grade) School Leaving Certificate that has his DOB which we will provide. He has a self-affidavit that he used for getting his passport - can this be used? Can an affidavit from a younger brother help - if at all even possible? Also does he need a specific letter from civil authority that BC is not issuable or given his age and circumstances, this may not be necessary.

    Thank you very much.

    Hi,
    1. your father does not need marriage certificate. you need to attach your mother's death certificate. its understood that "the marriage ended when the spouse died"
(my father died few years ago, so when I processed my mother's visa, I gave my father's death certificate. my mother also doesnot have her marriage certificate)
you may attach the affidavits you made. that will prove that you were born in lawful wedlock.

    2. my mother got her birth certificate showing her sslc records. In municipality they ask for the old records. you should be able to get that.

also keep extra documents ready for proof of relationship between you and your father. it could be your old indian passports, old family photos, your school documents, property documents etc. etc besides your birth certificate. I have seen they always ask for 'extra documents' for proof of relationship when it comes to Father compared to mother.

Thank you Rakhee. Very helpful. Quick question - did you apply for GC in US or did you do consular processing in India?
