Guys - need your help urgently. My parents are in US on B2. Their I94 expires on Sep 12. I'm a citizen and am planning to file for their GC.
I want to extend their stay and was evaluating 2 options:
1) Apply for extension of B2 and then do step 2. I believe I'm already late with only 4 weeks remaining. Also, the fee is $300 which is pretty steep.
2) Apply for I-130 for both parents. I understand that they can either follow AOS or CP once I-130 is approved. My dilemma is, should I go for AOS or CP?
Q1 - If I-130 gets approved before their I-94 expires, are they allowed to stay and file for I-485? OR
Q2 - Is the stay dependant on I-485 process? In that case I can file I-130 and I-485 concurrently.
Q3 - Is is realistic apply at this time and expect them to get an extension based on GC applications (I-130 alone OR I-130 + I-485)?
