  • I-130 14th question

    My wife is in the process of filing my family-based green card who is a US citizen.

    I arrived in the US originally as a student but now I am on H1 and have a H1 stamp on my passport too. I recently made a trip to India, so my I-94 says that I entered the US recently on H1.

    In the I-130 for :

    Question #14: He or she arrived as a: Should this be student or temporary worker? What should I enter here.

    The very next line in the form asks for Arrival/Departure Record(I-94) and date arrived. This clearly means this refers to my current I-94. so for question 14
    I should enter temporary worker?


    Question #19:Relatives address abroad

    Should this be my address in India even though I currently stay in the US? The address on the my Indian passport
    is the Indian address.

    My current Indian passport expires in March 2010, is it necessary I renew this passport before my green-card is issued or can it be done later?

    Experts please advise.

    1. Yes - Temporary Worker.
    2. Whatever is your valid address in India.
    3. It is not necessary to renew it first before applying for green card.
