    Hello,
    I am in US almost 6years. I entered Us with Visitors visa(90days) got married with my husband and filed I-485, I 864, I-130, I-765 etc...before my visa is expired.
    Everything went smoothly till He(husband) deployed to Iraq, during that time had interview but could not make it on that date and we just could not figure what to do after that....anyway we went to USCIS office recentry officer told us that file is in national center (if I remember right...) and was put away 2years ago.
    Can not re-open the case so now I need file everithing again.
    My question is what to answer on Form I-130 C16.
    Has your relative ever been under immigration proceeding?
    similar to I-485 part3
    Have you ever before applied for permanent resident status in the US?
    Another question what to answer, I-765 15
    Currant Immigration status
    similar to I-485 part1
    Current USCIS Status

    Please advise! really appreciate your help

    your answer can be no
    Have you ever before applied for permanent resident status in the US?
    since you applied before answer should be yes
    Currant Immigration status
    your answer can be b2 visitor if asks you whether it is expired or not. select expired.

    if your husband was abroad and if he still deployed just get your insurance card and his deployment paper you can have the interview by yourself.
    if he is here just resend the applications you can correct things during the interview. national visa center is for applications which is handled by the consulates which is not your case. I think you status has expired long time ago according to law here if you are out of status in the united states for more than 6 months and less than a year if you leave the country you can not come back for 3 years. if you were out of status for more than a year and leave the country than you can not come back for 10 years. so you should get your greencard before leaving the country.
