    Hi,

    My finance who is a US citizen would come from US to India to marry me next month. This is a arranged marriage. Both of us have had previously divorced marriages. And I have a H1B visa valid and planning to move US as well.


    Can we guys marry here, then I move to US on my H1b, register marry there again and then appply for the familybased Green card.

    Please give in your information...and suggestions...

    You need not remarry in US to apply for a family based GC. As you are on a H1b, you can enter US on the H1b provided you have a valid job and continue to work for the employer. Once you are back in US, you can apply for a family based GC based on your marriage. Make sure you register the wedding and also look at rules for non-indian citizens to marry in India.

      Hi, Thanks for the info.

      I have one clarification.

      I am moving to US on H1b first time. I'm still in India and would move there on H1. I dont have a project yet assigned. My employer has asked me to come there and search for projects...Thats the plan as of now.

      So after marrying here in India, I plan to move to US on H1b along with husband. And later plan to apply for family based GC.

      I hope this is fine...let me know on this.

        You should have a job on H1b to enter US and need to get paid all the time to be in status. You cannot just enter on H1b without a job and that fraud might even hinder your family based case.

        You also need to look into the K visa category. Immihelp all the info.
