  • Help with I-864

    Hello, need help filling I-864 & I-864A
    Here is the situation:
I have 2 separate petition I-130 as a US Citizen, 1 for my wife and the other one for my 2 years old son.
I have low income In 2008(6300)and my current salary is 18,720.00*
I am filling a I-864W for my Son petition and
I am filling a I-864 for my wife with a I-864A from my brother who is my household member. My brother is divorce and have 1 child, his 2008 income was 28,500.00 and his current salary is 24950.00.
    Questions :
    1. In Q. #21d of I-864 do I have to put 1 there even though I am filling a separate I-864W for my son.
    2. In question 21g. Do I have to put 1 there or 2 because my brother have 1 dependent.*
    3. In Question 13 of I-864A where it says indicate number of immigrant(s) you are sponsoring, Do I have to put 1 or 2, do I have to count my son even though I am filling a separate I-864W for him.*
    Thank you very much.*

    1. yes. It specifically says there "Persons NOT sponsored in this affidavit". Since the person you are sponsoring in I-864 is your wife, your son will be a "person not sponsored in this affidavit".

    2. one. I think your brothers "dependent" is not "combining his income with yours by submitting Form I-864A" even though he has the same principal residence as yours.

    3. one. treat each affidavit as a stand alone thing. I-864A is completed by your brother and not by you so technically, your brother is sponsoring only 1 immigrant.

This is my opinion. I hope that helps but anyone can refute or confirm.
