Hi - can someone please provide any views or experience on this situation of mine? I appreciate any help - thank you.
I, a US citizen, petitioned an I-130 for my widowed father when he was visiting me in US in July 2009. We planned to do CP in Mumbai at the end of his stay in Jan 2010 so I have not filed for AOS. I-130 was approved on Sept 21 (priority date of Aug 23rd) and visa petition sent to NVC.
This month, my sister unexpectedly passed away in Canada and my father wanted to attend her funeral so I got him an emergency Canadian tourist visa in New York and now after the funeral etc. my father wants to return to US from Canada. He has multiple entry US tourist visa but given his I-130 approval, will he have issues entering the US? Under normal circumstances he would never have traveled outside the US - so not sure what will happen. Will he be deported to India? Will this jeoparize his GC process through CP etc? Any advice/thoughts greatly appreciated.
