    Hi all,

    Thanks for looking. My case is that I do not have a birth certifcate. I received a RFE for birth certificate for my I-485. But I could neither get the non-availability certificate nor the original certificate. I just have 5 more days for my 87-day RFE to end. I do have a certificate from the hospital saying that they never reported my birth to the municipality. Will that suffice along with the secondary evidences? Any thoughts? Suggestions? Please help me out everyone.

    I also have affidavits from 3 people. Should I send the originals to USCIS or will it suffice if I just sent attested true copies of the originals? Please advise. Thanks SO much for taking time to read. Will greatly appreciate your suggestions.

    I'm wondering why you cannot get a non-availabilty certificate. I mean all you have to do is, show your hospital record to the concerned municipal authorities and request for it.

      Do you have school certificates? 10th 12th? if they have your DOB on 'em, send those. Yes, send those affidevits .. you can send origionals or the attested ones..does not matter as far as they know you are sending legit documents. I was tight on time line too.. so I got scanned copies, made a print out.. overnighted those to NVC, now mom sent origionals via VFS before the interview... they said she cud take em with on the interview day too (The original ones)

      Unobtainable birth certificates
      The applicant’s birth record may not be obtainable. Some reasons are listed below:

      The applicant’s birth was never officially recorded.
      The applicant’s birth records have been destroyed.
      The appropriate government authority will not issue one.
      Please obtain a certified statement from the appropriate government authority stating the reason the applicant’s birth record is not available. With the certified statement the applicant must submit secondary evidence. For example:

      A baptismal certificate that contains the date and place of birth, as well as both parents names (providing the baptism took place shortly after birth)
      An adoption decree for an adopted child
      An affidavit from a close relative, preferably the applicant’s mother, stating the date and place of birth, both parents names, and the mother’s maiden name.
      Note: An affidavit must be executed before an official authorized to take oaths or affirmations. More specific information is available from the NVC.

        Nonavailibility Certificate of Birth

        I had applied for search on my mother's Birth Certificate in Mumbai Municipal ward office who was born in 1937. They could not find her birth record in ward office as well as in Head office at Crawford market. Information as to in which hospital she was born is not available as parents have expired decades ago.

        Ward officer in Birth Registration office does not want to issue Nonavailibility Certificate.

        I am unable to get someone older than her who knows about her birth.

        Please guide me what can I do in this matter?

          Do not worry

          I was in the same situation and your DNA, I repeat DNA test will override every issue there is. If you cannot prove that she is your parent on paper, they will ask you to take a DNA test to prove that. That will overide everything so do not sweat it.
