  • I-130 Pending for Brother (PLEASE RESPOND)

    Hi,

    My sister is a US Citizen. While on my visit to US in 2008 she applied I-130 for me. I am over 21. I received a "Receipt Notice" in a month and I later returned to my home country.

    "Received Date" on that notice is 23rd Dec 2008. I keep checking the "Processing Time" on USCIS website. It noticed that the processing date has now changed from 1999 to September 2007 for "US Citizen filling for Brother/Sister".

    Can anyone please tell that does this mean they are processing 2007 applications now? Does this processing table tell that they are currently issuing "Immigrant Visas" or "Green Card's" to people who applied in September 2007?

    Please respond. I am very confused and eager to know. Its been almost 1 year that I applied for I-130. I haven't received any "Approval Notice". When can I expect to receive the "Approval Notice".?

    okay, so I take it you understand that the Service Center processing dates are not indicative of when you will get a visa number... right?

    So say you are approved now ( Vermont has the 2007 processing date for your category , which is 4th). Then you have to wait for a visa number. Look at the below chart and you will get an idea of when you can expect a Green Card to migrate.

    As you can see depending on where you are from, it will be 10 yrs or more to your priority date.

      So what does the processing table mean when it shows September 2007 processing date? Please explain.

        I am trying to explain to you that even if your I 130 were approved today, it only gives you a space in the long line for a visa number. It does not mean you will be given a green card when the I 130 is approved.

        You have to go by the state dept visa bulletin dates to figure out when you will be contacted to start the visa process.


        Oh and by the way, saying thanks would have been a nice touch to precede your follow up request !

            If my I-130 gets approved while I am inside USA on a Student/Visit visa, can I apply for Adjust of Status Form I-485?

            Or do I still have to wait 10 years for visa number to be available.
