  • RFE for mother's name discrepancy

    My wife applied I-130 for her siblings. NSC is processing them and I have got an RFE in one of the sister's petition.

    Among other things:
    B. The evidence provided indicates the mother of PETITIONER is named Manisha. USCIS records indicate her name has been previously provided as Manchcha. Please provide documentary evidence to explain or resolve this discrepancy.

    Manchcha is mother's maiden name while Manisha is mother's name after marriage because Manchcha sounds old fashioned.

    As USCIS has not specified the exact document, what exactly should we provide?

    mother's marriage certificate or any other document proving the name change.

      It just lists the names of the persons at the time of marriage.

      If the female adopted the husband's last name after the marriage, marriage certificate would be helpful in proving the last name change.

      However, the marriage certificate does not seem to have any place where we could specify the change of first name due to marriage.

      In this case, no such document was filed anywhere regarding the name change and everyone started calling her by newly adopted new name in the in-law's place after marriage.

      That is the confusion. What exact document to provide?

        I would say the person has to go through the standard name change procedure by advertising in newspaper and get a judge sign the name change. This is the only way out that I am aware of if the modern name needs to be used.

          my mothers name was shortned in the birthcertificate. so I provided 2 affidavits from my maternal uncles stating both names indicate the same person.
          so I think, you can get affidavits from your mother's sibilings or parents saying manchcha is fondly called Manisha at home. Both manisha and manchcha indicates the same person.

              Affidavit

              I, -----------(uncle's name) son of -----------,Indian Hindu aged about --years and residing at ---------------------,do hereby solemnly affirm on oath and sincerely state as follows,
              1. I'm the deponent herein.
              2.I'm the elder brother of ---------(your mother's FULL current name). My sister ----------was born on -----(DOB) to my parents ------(Father's name, as appears in her birth certificate) and ----------(Mother's name) at --------(city, state), India.

              My sister is fondly called as Mala by our nearest relatives. Her official name is Malabai. Both Mala and Malabai only denotes to my sister Malabai.

              So I do hereby solemnly affirm by declaration mentioned above before Notary Public appointed by ------ Government having his office at ------(city)

              --------------------------------------------------------------------------
              1. Its better to get affidavits from people who are older than your mother.
              2. Its also advisable to get atleast one of these affidavit from your mother's birth city, if you can.

                Received RFE to provide Marriage Certificate for my Mom's GC... Help Needed !!!

                I have applied Family Based GC for my Mother... Received RFE to provide marriage certificate ...
                They have married 60 years ago and marriage was not registered. My father is deceased now...
                I am not able to get a 'no record' of the marriage certificate from the authorities... I am trying to create an affidavit and have my uncles/aunt sign it stating they were a witness of the marriage...
                Is there another alternative?

                  Proof of name change for mother. No marriage certificate.
