      thanks for immidiate answer.
I am sorry but still I am confuse.
Let me clarify my detail, my sister filed on dec'2000, she got letter back with case no on June'2005.
should I submit adjustment of status now, or I should wait till the date in visa bulletin cross dec,00 or june'05.

      Thanks

        Hello,

I found it...priority date for my file is Dec 4 2000, its on my receipt. So here is my simple question, should I file for adjustment of status now. Since when my sister file for me, i was in India and now I am in USA.

        Thanks

          Hi.

Your priority date is December 4, 2000. The current priority date on the visa bulletin is October 1999. You cannot file for adjustment until your priority date becomes current. It will take approximately a year for the priority date to move from October 1999 to December 2000. If you are still here on a valid visa when the priority date become current then you may file for an adjustment of status. If you fall out of status or are in India, then you will have to go through consular processing and apply for an immigrant visa abroad. Check out visalawyergroup.com for more information on family based immigration and adjustment of status. It does a good job of explaining who can adjust status and when to go for consular processing.
