I am a bit confused... I have read an article that explains to the recent law Pres. Obama has just signed last October, stating the surviving of a petition even with the loss of the petitioner. the article said that it is limited only to the beneficiary living in the US. I was petitioned by my father under F2b, my priority date is September 2003. i am still living in the philippines. however last 2007 my father suffered from a severe stroke and is now paralyzed. i am afraid that his condition is deteriorating even with the care of my 3 younger brothers who lives with them in the states. i am afraid that he already has a short time. and may not wait for the approval of his petition. My question is, Is our petition still valid even when he is gone and me the beneficiary living outside US.?
