  • I-130 petition for my brother and sister

    Hello,

My parents filed I-130 for my brother and sister over 21 yrs old that lives outside U.S. on March 2004. My parents are Permanent Resident GC holder.

I recently received my Naturalization Cert last August. therefore, i am a USC.

My question is should I file I-130 for my brother and sister now that i am a USC? will my petition overrides my parents petition and the processing time will be faster??

If not, should my parents become USC and then re-file I-130 for my brother and sister?

My Parents are thinking if becoming a USC will make the petition faster if they re-file I-130 for my siblings.

We are just doing this in order for my siblings to join us here living in the U.S.

    Thank you for your reply,

    Jeff

Look at different categories at https://www.immihelp.com/family-base...rd-categories/

Also look at their processing times at http://www.immihelp.com/visa-bulletin/

        Hello Jeff,
A petition from brother to brother takes about 12 years, if your parents become USC and your brother and sister are not married they jump to the first category (I am not sure how long, but this category moves faster), if they are married it takes 9 years..when can your parents become USC?

          Hi jeffcarpizo

I think it is great that your parents have filed for your siblings before waiting for US citizenship, it means that when they do become US citizens then they can just file their adjustment of status, in the mean time your siblings are already in queue. If they get married during all this ..then that's a whole different story.

Question about USCIS Processing Time Information

My brother in law applied for a I-130 for my wife on June 13, 2011 in California Service Centre. My question is how long it will take to process it. I've checked "USCIS Processing Time Information" at https://egov.uscis.gov/cris/processingTimesDisplay.do

In I-130 Petition for Alien Relative U.S. citizen filing for a brother or sister showing June 22, 2011. What does that mean? Does it mean USCIS start processing the application? In that case how long it normally takes?

Thank you for your time and help.

Hi, do you reside inside US or outside US. Because my brother in law too filed for my wife this feb,2015. But we are in US currently.
