  • PLEASE help me with I-864

    hi every body. HAPPY NEW YEAR TO ALL

    i paid AOS fee $ 70 on dec 09 /2009
    IV fee $ 400 on jan 08/ 2010
    i printed out document cover sheet
    what should be my next step ?

    pls someone tell me do i have to 1-864 all forms or any one of them ? i have't get any response from NVC for sending i-864. do i have to wait?

    Hi,
    It is scary at first when you read the instructions on I-864 form but it is rather simple once you understand the logic behind this contract.
    It is basically divided in to 2 sections as far as filling out the form is concerned.
    1- The petitioner is qualified to fill out this form on his/her own and passes the poverty guideline. He/she should collect the supporting documents plus the cover page and mail them all in.
    2- The petitioner does not qualify and needs to bring in a co-sponsor in order to satisfy the minimum income set by immigration services. No matter what route the petitioner has to take, he/she always fills out the I-864 form. The difference comes in when the petitioner is someone else’s dependent or not. If the co-sponsor is just someone who wants to co-sponsor the applicant and has not claimed the petitioner as dependent on his/her tax return, he/she fills out another I-864 just like the petitioner, both of them put all the needed documents together and sent in the package. This is a contract between the 2 parties and US government to make sure that the arriving immigrant(s) do not become US tax payers’ problem while their status remains as legal permanent residence (LPD).
    Now, what if the co-sponsor is related or has claimed the petitioner, or the other way around, as dependent and live in the same household? The cosponsor files out the I-864A and the petitioner files out the I-864 forms both collect all the supporting documents together with the cover page and mail them in.
    The I-864A form is a contract between the petitioner and the co-sponsor, in this case, that he/she will not allow arriving immigrants to become tax payers’ problem.
    This was my understanding of these forms and hope I was able to help. If someone else could add or make any correction to this post, by all means do participate and make your voice count.

      After AOS fee paid you'll see a step to go on filing i-864. If your income is above poerty guideline then you need no co-sponsor.

        tnx a lot ur info. helped me lot to fill out this form. i am only sponser so it was not that complicated i was thinking. so my income is good enough .i just send today i-864. i'll see wt happenes next.

          i-864 help needed

          hi all.
          i am here in us on my valid h1b since 2006 and my h1b get expire in 2012.i recently got married to a USC girl. now we are filing for my GC. in i-864, she does not meet the requirement of 125% above poverty line. So if i want to show my own income which is around 50 k well above 125% of poverty line, how would i do this? should i fill a saperate 1-864 or we just include my income in her i-864 line 24?
          Appreciate your help and time.............

            you will have to fill out i864A , for ur income to be combined with hers ..show proof of employment, tax returns , etc.

              i dont think u have to wait a letter from nvc to proceed. just go ahead and fill out i864, send it in along with all other pertinent documents.

                Help for i-864 my parents

                Hello sir,

                i reday to submit form i-864 for my parents mom and dad i have one problem during fill form for my dad how can i count my mom and where i enter my mom name becuse i seprate file petion for my mom .if i enter my mom name qustion no. 9 under part 3. But her they said do not include any relative list on the seprate visa petion .please help me thank you

                  Question over question

                  Hi , I have a similar question related to yours: I married a USC but she does passes the 125%. However, one of the questions in I-864 (question 24-c of affidavit of support) is what is the total household income. Since we live together that income is hers + mine. Question is: should we write the amount of our 2 yearly incomes together? or just hers (the sponsor?). Also, because we filed taxes jointly and if you look at the tax return form, the amount is from both salaries.

                  A second and simpler question. Some documents are required more than once, to give just one example, copy of intended immigrant's passport in I-485, in I-130 and in I-864. Question is: should I include in the packages as many copies as per each form (3 in this example?) or just one?

                    Sponsor?

                    Hello!
                    I have recently married a US citizen, a very nice girl whom I have been in love with for over 2 years. We prepared all documents, the problem is my wife does not make enough to sponsor me. So I understand we have to find someone else and we have been asking around but with no success. I am starting to feel disillusioned with everything. What options do I have?
                    Any ideas?

                      I was under the impression that if the income of the spouse is being used to meet the requirements, form I-864A does not have to be filed. This is from the I-864 form instructions:

                      "If certain conditions are met met, the intending immigrant's income can help you meet the income requirement. If the intending immigrant is your spouse, his or her income can be included if it will continue from the same source after he or she obtains lawful permanent resident status. (...)
                      However, an intending immigrant whose income is being used to meet the income requirement does not need to complete Form I-864A, Contract Between Sponsor and Household Member, unless the intending immigrant has a spouse and/or children immigrating with him or her".
