Can sister's daughter - Unmarried, full-time student, 22 age can get Green card?

  • Can sister's daughter - Unmarried, full-time student, 22 age can get Green card?

    I am a US citizen. I applied for my married sister's Green Card petition in 1999. Her 130 approval shows the following dates:

    Reciept Date: 3/5/1999
    Priority Date: 2/16/1999 -- is now current
    Notice Date: 12/16/1999

    My niece has just turn 22. She is an unmarried, full-time engineering student. Financially fully dependent on my sister.

    Initial corrospondence from NVC doesn't include her name. It has my nephew name who is 18 years old.

    Is there a way she can get Green card or come to US with them? Will CSPA kick-in for her?

      If you mean when did I received I-130 approval, it is in 4/15/1999. Since then waiting for priority date to become current. I recieved the notice from NVC in Aug 2009.

        In that case, 22 years old is not eligible.

        Even after applying CSPA, she is too old.

          notice date

          the notice date is the approval notice itself...so you can deduct the time from receipt date to notice date only...so about 9 months even then she wont qualify for cspa....
