Removal of Conditions from GC

Hi all,
I am new to this forums. I got married to US citizen and its now been near to two years ans we have two kids and its time for me to apply for removal of conditions and our relations are not so good we are in the stage of getting divorce. I cannot apply joint application for removal of conditions i have to apply by myself at this situation waht are the chances of getting it approved since my marriage is genunine and had two kids. Please advise.

As long as you can prove that you entered into the marriage with good faith intent, you can remove your conditions even without spouse support.

Try to get as many evidences as possible for proving this. Also, try to get some affidavits from close friends and relatives about this.

I suggest that you get an immigration attorney as this is not as simple as it sounds, particularly, without spouse support.

First of all, don't worry. The divorce rate in this country is near 50%, I think. This means that USCIS has seen plenty of cases where the marriage was entered into in good faith but due to some circumstances that marriage doesn't last. It is true that if you are in the process of getting a divorce, then you cannot file a joint application. You are going to have to file a waiver of the joint application and submit a lot of documentation. Timing is very important when it comes to cases like this. When you file is just as important as what you file. You should do some research and maybe even speak to a lawyer who has experience in this matter. I have seen some good information at the visa lawyer group's website and you can even speak to an attorney for free. Don't worry, situations like this come up all the time and have a qualified attorney guide you through the process will make this easier.
