miserable marraige, cancel greencard

Hi,
I am a US citizen and I filed for my husbands greencard. He resides in India and looks like he married me only for getting a greencard. the greencard was approved conditionally and I still have it with me. I filed for divorce in US court and hes saying that he will sign hte papers only after he gets his greencard and its unconditional status is removed a year from now.

Can I apply for cancellation of his greencard so its out of the way in getting a divorce?

If you don't cooperate in getting him permanent green card, and if he can't prove that he entered into the marriage in good faith, the conditional green card would expire anyway. It is not automatic renewal.

Can I apply for the conditional green card cancellation? Hes been nothing but abusive to me. I want to move on with my life and not wait till the conditions clear next year.

Green Card Cancellation

What the administrator says is right. You cannot cancel the conditional GC but yes it expires after a year you dont have to renew it. If not renewed it expires and thats it. If you are a USC you can apply for divorce for your side in an US court. If the court grants you divorce (most likely it would) then that divorce is good in India too, according to a recent supreme court verdit. Thus you can as well proceed with the divorce, even though he has a conditional GC
