  • Green Card and Taxes

    Hello people, I recently married a US citizen and so we are about to send in all the necessary forms to immigration. I have a few issues I need help on;

    1-I was a F-1 student (not anymore) and never got a social security number, so I can't file tax with my wife for 2009--would that be an issue?

    2-She owes 40K or so in student loans and I refuse to be responsible for them even though I love her.

    Do you think it will be an issue, if my wife files her tax as single or Married Filing Separately, in the eyes of immigration or at the interview?

    Any help will be appreciated

    You can file takes, as married filling jointly before IRS. During interview they would like to know that the marriage was entered in good faith, filing jointly helps. Even if you are on F1 you can file 1040ez, or 1040 and you would be taxsed as a resident, you can apply for a tax id number before filing. If you were on F1 still you are required to file taxes if you had any income here in the US.The student loans your wife took would not affect you as only the borrower is responsible, but if she defaults on them your credit rating can also be impaired as agencies look at spouse information too. If you love her and she is helping you then you should morally be responsible for the loans too.

      Thanks very much--I'll do just that.

      Can I file all the forms ( I130, I485,G325A, I864, I765, I693) to

      P.o box 805887
      Chicago, IL 60680-4120

      or do I have to send them in separately.

      Thanks
