  • Help- Does incorrect spouse name in parent's passport affect parent's GC processing?

I have this situation wherein spouse name was incorrectly entered by Indian passport office in mother's passport. Instead of entering father's name, they entered mother's (passport holder) name (self) as spouse on the last page of the passport. I am a naturalized US citizen and planning to apply for GC for my mother. When I went over I-485 instructions, it says the following about passport copy under required documents.

    3. Copy of passport page with non-immigrant visa

If you have obtained a non-immigrant visa (s) from a U.S. Embassy or consulate abroad within the last year, submit a photocopy (ies) of the page(s) of your passport containing the visa(s).

Now, unless it is really needed to make correction in the passport for immigration purposes, I do not want to go through the process of correcting spouse name in the passport for family reasons.

Did anybody enounter this situation wherein they had incorrect spouse name for a parent's (mother) passport; but I-485 with correct spouse name was still approved for parent though there is a mismatch with the passport.

Any input will be greatly appreciated.

    Thanking you,

I have no experience with the situation mentioned but do not see how it would affect GC processing. It does not appear that it is something they would even see.

In the item you listed, it is asking that you provide a copy of the passport page(s) that contain a non-immigrant visa. If your mother has not received a non-immigrant visa within the last year then you do not have to provide copies of any pages from the passport. If she has received a non-imm visa, then you provide only the pages with the visa(s). So, unless she has a visa which is on the same page as the spouse info, that info will not be known. But even if it was, I fail to see how it would make any difference.

      Thank you for your comments

      Hi BeenThereDoneThat,

Thank you for your valuable comments. I derived similar conclusion from what is stated in I-485 application. My mother obtained her 10 years multiple entry (B2) visa from US consulate in India in 2002; and she visited me in the US twice as a B2 visitor on this visa wherein passport carried incorrect spouse name as stated in my orginal entry.Technically speaking, sending passport copy regardless of no. of pages from passport doesn't apply since visa was obtained in 2002.However,when I called couple of immigration attorney offices, they said that they send all pages of passport copy along with application documents. In the first case, one of the associates of attorney office (I believe he is attorney too) mentioned that incorrect spousename doesn't affect I-485 approval because I will be submitting my birth certificate wherein correct parents' names are mentioned; and if it all USCIS points this out, a self affidavit by the applicant can be provided to USCIS stating that it is a mistake by Indian passport office. In the second case, attorney mentioned that spouse name needs to corrected and all pages of passport copy needs to be submitted along. This got me worried and I am trying to get any input from the valuable members who might have gone through similar situation.

I appreciate your comments and looking forward to other generous members to chip in to help me in this regard.

      thanking you,
