my husband US citizen, we been leaving togheder before 5 months in usa in 2008 having bouth our name on apartment lease not maried, me with 10 years turist visa. i return in my country before my I-94 expired. now i comeback in july 2009 and they wrote in my passport " no change of status" "no extension' and alowed me to stay one mounth. before expiration date we got married and we live at the same address. now we want to start GC application. there is any risk to dont be aproved?

If they said you can't do it in the US, then you can't do it in the US.

The best thing is your spouse applies for your I-130 petition, and once approved, you apply for immigrant visa in your home country. Leave in 1 month and wait for the process in your home country.

thanks for your answer. so, should i expect of they to send me home after we aply I-130 because I cross the !-94? there is no chance to get adjusment of status staying here? tell what you think

I-130 may not be denied. But I-485 may be denied and you may be asked to go back home and get immigrant visa. Unnecessary delays and hassles.
