Hi All, I need some help and advise,
I came here as an exchange student, and changed my status to F1. During my period in school my sponsor and my Dad passed away and i had to leave school due to sponsorship. as in school i was dating a USC and we got married 9 months later. me and my wife went for the interview and was denied on the basis that we did not have a bonafied marriage but was not charge with fraud. this was because my wife had told the officer that i slept at home only a few times which i explained that i had a history of asthma and that i could not withstand the excessive smoking by my mother in-law who has stroke and can not smoke outside the house and secondly i could not tell whether one of my sister in-laws child who's name my wife mentioned during the interview was a boy or a girl.
The office Denied as but gave as a chance to appeal. My lawyer has filed the appeal and requested to view the interview recording to make a brief since we did not have a lawyer during our first application. This am told will be a slim chance of decision reversal.
Recently we received a letter saying that i did not fulfill the requirements of my F1 so am being put on removal even though we have an appeal in progress and this a court date has been set.
I went for a second a opinion and and i was told i could file the I-130 and if am lucky it will be approved with out an interview. How true is this?
Can any body advise on what to do? don't want to leave my family.
Please need urgent help.
