    Hi everyone, I'm a full time student, I have never file a tax return, since I have never work I'm claimed as a dependent on my father's tax return, however as a US citizen I'm filling a petition for my mother (currently divorced) and I'm using a joing sponsor since I don't have any source of income or assests, do I have to complete I-864 for my self and leave blank all spaces related to income information, and attach a letter of explanation why I have never file a tax return?.

    Second question does the joing sponsor that I'm using have to complete a I-864 as well since this is the only source of income that I'm using?

    Third question, the joing sponsor is married and claim the taxes together with his wife, does the wife have to complete an I-864A or any type of form, since her income is going to be use as well because they claim taxes together?

    Please any information will be grately appreciated.

    My take on your questions:

    1) Do you have to submit I-864?
    Yes. Even though you, yourself, have no income you are still the petitioning sponsor and, as such, are required to submit I-864.

    2) Does the joint sponsor have to submit I-864?
    Yes. All sponsors must submit I-864.

    3) Does joint sponsors wife have to submit I-864A (or other doc) as income from both will be used to meet income requirements?
    If the joint sponsor is relying on his wife's income as well then, yes, she would have to submit I-864A.


    I hope they understand that by submitting the I-864s they will be financially responsible for your mother once she immigrates.
