RFE on birth certificate (I-485) for petitioner listed on Form I-130

  • RFE on birth certificate (I-485) for petitioner listed on Form I-130

    Sir,

    I am a US citizen who filed GC application (I-130 and I-485 combined) for my mother. Though I had submitted copy of my non-availability of birth certificate and copy of my Indian (canceled) passport biographic page for evidence of parent relationship, I recently received an RFE for my birth certificate.

    I am planning to send the following documents:
    1) My original non-availability of birth certificate from Government authority.
    2) Original of Mother's affidavit for proof of parent relationship (My father is no more)
    3) Copy of my wedding invitation by Mother.
    4) Copy of my baby's USA birth certificate listing my mother’s maiden name.
    5) Copy of my Indian (canceled) passports biographic page for evidence of parent relationship (sending again)

    When I am planning to send the above documents,
    I. Do I still need affidavits from two of my close relatives?
    II. Do I have to send all originals?
    III.Do I need to send a copy of I-485 application too?

    Two original affidavits by close relatives and copies of other secondary evidence you wrote.

    You don't have to send the copy of I-485 application again.

      You can also use school records, where your mother's name appear, I had to send RFE also and all I send was my school report card with my mother name...and that's all they needed...good luck..

        FYI
        My Mom's GC got approved.
        Here is the time frame, hope it helps someone.
        1) Jan 25, 2010 - I130 Rcv'd date (Notice date Feb 1, 2010)
        2) Feb 9, 2010 - RFE for my birth certificate (I sent 2 original affidavits from close relatives)
        3) Mar 2, 2010 - I765 Fingerprint appointment
        4) May 4, 2010 - Green Card Interview approved (also got stamped the same day since we have plan to travel)
        The examiner commented all papers were properly documented and hence got GC approval in just 3 months :-).
        She said the Green Card will be mailed to us in 2-3 weeks
