I am looking to apply for a GC for my dad who came on a tourist visa about 3 months ago. This is his first visit to USA. Since he came here, his elderly dad passed away in India. As such, there's no reason for him to go back anymore.
Is it okay to apply for a concurrent I-130/I-485 filing for him given that this is first visit? What happens when his tourist visa expires in 2months? Also, in the worst case scenario, what happens if in case the I-130 gets rejected? Is he forced to leave immediately?
