  • Fastest route to sponsor a sibling 21+

    Hello:

I'm a US citizen and I'm trying to sponsor my brother (European, Spain).

I understand that siblings visas take a while to go through, so I'm wondering if it'd be faster to sponsor my mother first, then she can claim my brother?

    Thanks

If he's unmarried (and remains unmarried) and born in any country other than Mexico, it's faster to petition your mother first, and then she petitions your brother (in the F2B category for unmarried over-21 child of permanent resident) than for you to petition your brother directly (in the F4 category for sibling of US citizen). Of course, both you and your mother can petition him just to be safe; one can be the beneficiary of multiple petitions; they do not conflict.

This is my personal opinion and is not to be construed as legal advice.

      Thank you very much!

Does anyone know what are the wait estimates in this hypothetical case for both my mom, then my brother via my mom?

      Thanks!

You can look at the visa bulletin to get a sense of the wait time. For the F4 category (for siblings) for people born in most countries, a visa number is available now for petitions filed more than 13 years ago. If you petition your mom, it'll be in the Immediate Relative wait with no wait for visa numbers, and she can usually get her immigrant visa in about a year. Once she enters the US, she can petition your brother in the F2B category, and for the F2B category for people born in most countries, a visa number is available now for petitions filed about 6.5 years ago.

If I petitioned for my brother 5 years ago, can my parents petition for him too? How do you go about that?
