  • Parent's Green Card while in USA

I would like to share this information with Immihelp.com readers:
My mother came to USA in 1996 on a B1 visa. She overstayed her visa, and was here in USA until I became USA citizen. I applied for her green card in December 2006. She got her green card without any personal interview. Following is the timeline:
Arrival in USA on B1 visa: 9/1996
    I-130 submitted: 12/17/2006
    I-485 submitted: 12/17/2006
    I-765 submitted: 12/17/2006
    Received Letter for biometerics: 12/21/2006
    Biometrics date: 1/6/2007
    Green Card Approval Letter: 1/25/2007
Received Green Card in mail: 1/30/2007

Even I was surprised that she got her green card without any interview. I would be happy to answer any question any body has.

      This is amazing!
It practically took your mom only a month and a half to get her green card!!
I am just gathering info about this process and was wondering if my mom needs to go to an interview and if she needs to know English.
But your post answers it. Do you know if this is the typical way this process goes?

        Great! It was very quick..

I am a US citizen and brother is in US on H-4 dependent visa (his wife is on H-1B).

Can I submit Form I-130 and Form I-485 both at the same time? or I need to wait until I-130 approval? Please help me.

You will need to wait until the priority date is current, which will be around 10-12 years from the time of filing I-130.

            Doubts on GC for Mother

            Immihelp Admin,

Need help on following 2 questions:

            1) Is there a link on this site where we can find the list of all supporting documents which are required along with the Greencard filing for my mother? Like, I have heard that we need Police Verification Certificate from the District HQ in India and a Clearance Cert. from local Passport Office. Is it true?

            2) My mother has been visting us in the US for last 10 years on multiple entry B2 visa, which is due to expire later this year . She is currently in India and is planning to visit US later next month. Will it be an issue for her at the port of entry, as I am now a USC (my status changed from GC to USC in last few months). Pl. note that my mother's current B2 visa is in next 5 months.

Thanks in advance for your suggestions.

Thanks a lot for the links. However, I could not see the link for the documents like the police clearance from District HQ and passport office clearance letter? Are these really required to be submitted or its just a grapevine?

I guess that Police Clearance and Passport Office Clearance letter from beneficiary's country of citizenship are required for future immigrants to USA if the immigrant visa is to be issued from US embassy. I can say this based on my experience when my fiancee came to US on K1 Visa.

But if the beneficiary is here in US on non-immigrant visa, and the immigrant visa would be issued here in US, then the USCIS will have the beneficiary to be fingerprinted here in US. For example, my mother came to US in 1996 on B1/B2. She never went back to her country. She was out of status for 10 years. She was finger pirnted here. In Jan 2007, she got her green.

Note: This is true only for immediate family members like spouse, childeren and parents.

I am in a similar situation as you were, in that my mom came 5 years ago and has since overstayed her visa. I am a US citizen of course.
                      Did you consult a lawyer?
Did you file both i-130 and i-485 concurrently?
On part 2 of I-485, what box did you check? And what document did you attach to the application?
I lost my mom i-94 form: is it imperative to include it in theapplication?
Where you told that your mom has to return to your country for her visa processing because of her visa overstayed?
